California Consumer Privacy Act (CCPA) Disclosure and Notice at Collection

California Consumer Privacy Act Disclosure
This California Consumer Privacy Act Disclosure (“CCPA Disclosure”) supplements Resurgent's Privacy Policy. This CCPA Disclosure applies solely to California consumers, including personnel working on behalf of our business partners (e.g., vendors) (collectively, “B2B individuals”), subject to the exception listed below. For clarity, this CCPA Disclosure applies to personal information we collect about California consumers, both on the Website and offline.
This CCPA Disclosure does not apply to:
- Information we collect, process, or disclose subject to the U.S. Gramm-Leach-Bliley Act and its implementing regulations or the California Financial Information Privacy Act. If you have a financial product or service with us, we will use and share the personal information that we collect from or about you in accordance with our Privacy Notice, which offers you certain choices with respect to the use and sharing of your personal information.
This CCPA Disclosure uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 (the “CCPA”), as amended by the California Privacy Rights Act of 2020, and its implementing regulations.
Accountholders: If you have an account with us through which we provide you with a financial service, this CCPA Disclosure does not apply to you. We use and share any information that we collect from or about you in accordance with our Privacy Notice.
Non-Accountholders: If you are not a B2B individual as defined above and you do not have an account with us, and if we do not otherwise have contact information on file about you, then there is no reasonable method by which we can verify your identity as required by CCPA. This is because we do not link information we may collect about non-account holders (e.g., IP addresses, device identifiers or other information collected through automated means) to named actual persons. Accordingly, if you do not have an account with us and if we do not otherwise have contact information on file about you, and you request access to, or correction or deletion of, your personal information, we will not be able to process your request.
Notice of Collection of Personal Information
Categories of Personal Information We Collect
Most of the personal information that we maintain has been collected in the context of providing financial products and services for personal, family, or household purposes, and is therefore not subject to the CCPA. From time to time, we may also collect personal information relating to California residents in other contexts, including from B2B individuals and in connection with our websites.
We may collect (and may have collected during the 12-month period prior to the effective date of this CCPA Disclosure) the following categories of personal information about you:
- Identifiers: identifiers such as a real name, alias, postal address, email address, unique personal identifier, online identifier, internet protocol address, or other similar identifiers;
- Additional Data Subject to Cal. Civ. Code § 1798.80: signatures, financial information (such as bank account information, debit card information, and other similar financial information);
- Online Activity: Internet and other electronic network activity information, including, but not limited to, information regarding your interaction with websites, applications or advertisements;
- Sensory Information: audio information, such as call recordings, and other electronic or similar information;
- Inferences: drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, behaviors, attitudes, intelligence, abilities, and aptitudes; and
- Employment Information: professional or employment-related information, such as job title, references and other similar information.
Retention of Personal Information
We will retain your personal information for as long as reasonably necessary to achieve the purposes described in our Privacy Policy and this CCPA Disclosure, or any other notice provided at the time of collection, and consistent with our retention policies. When determining these retention policies, we take into account the length of time personal information is required to be retained to provide the relevant services; satisfy legal and compliance obligations and for audit purposes; address any complaints regarding the services; and defend or bring potential legal claims.
Categories of Sources of Personal Information
In the past 12 months, we may have obtained personal information about you from the following categories of sources:
- Directly from you or from your devices, for example, through your use of the Website;
- Internet cookies;
- Entities that provide services on our behalf;
- Online advertising services;
- Data analytics providers;
- Your employer, if you are a representative of a vendor or other business partner;
- Other individuals, such as in connection with a business referral; and
- Our affiliates and subsidiaries
Purposes for Which We Use Personal Information
We may use your personal information for the purposes described in our Privacy Policy and for the following Business Purposes specified in the CCPA:
- Auditing relating to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
- Helping to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for these purposes;
- Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your current interaction with us;
- Debugging to identify and repair errors that impair existing functionality;
- Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling transactions, verifying customer information, or providing similar services;
- Providing advertising and marketing services, except for cross-context behavioral advertising, which is addressed in the below paragraph entitled "Sale or Sharing of Personal Information"
- Undertaking internal research for technological development and demonstration;
- Undertaking activities to verify or maintain the quality of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us; and
- Managing our relationships with current and prospective partners, business clients and vendors and other business partner personnel.
We do not collect or process sensitive personal information with the purpose of inferring characteristics about California consumers covered by this CCPA Disclosure.
To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.
Sale or Sharing of Personal Information
We do not sell your personal information or share your personal information for cross-context behavioral advertising purposes.
Disclosure of Personal Information to Third Parties
In the past 12 months, we may have disclosed the following categories of personal information about you for a Business Purpose to the following categories of third parties:

In addition to the categories of third parties identified above, in the past 12 months, we may have disclosed personal information about you to government entities, such as in response to a request from law enforcement authorities or in connection with actual or proposed corporate transactions, such as mergers, acquisitions, or divestitures.

California Consumer Privacy Rights
You have certain choices regarding your personal information, as described below.
- Right to Know/Access: You have the right to request, twice in a 12-month period, that we disclose to you the categories of personal information collected about you; the categories of sources from which the personal information is collected; the business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we disclose personal information; and the specific pieces of personal information collected about you.
- Right to Correct: You have the right to request that we correct the personal information we maintain about you, if that information is inaccurate.
- Right to Delete: You have the right to request that we delete certain personal information we have collected from you.
In certain instances, we may decline to honor your request. For example, we may decline to honor your request if we cannot verify your identity or confirm that the personal information we maintain relates to you, or if we cannot verify that you have the authority to make a request on behalf of another individual. In other instances, we may decline to honor your request where an exception applies, such as where the personal information we maintain about you is not subject to the CCPA.

To submit a request as an authorized agent on behalf of a consumer, click here and follow the instructions or please visit our Contact Us page and provide us with a copy of the signed authorization from the California consumer that authorizes you to act on the consumer's behalf.
Verification: To protect your personal information, as well as that of others, once we receive your request, we will take steps to verify your identity before granting you access to your personal information or complying with your request. If you have an account with us, we may verify your identity by requiring you to sign in to your account. If you do not have an account with us and you request access to, correction of, or deletion of your personal information, we may require you to verify your email address or phone number in our records and/or provide the following information:
- Your full name
- State of residence
- Physical address
- Nature of your relationship with our company (Website visitor/Contractor/Business Partner Personnel)
- At least one of the following pieces of identification:
- The last four digits of your Social Security Number
- Your Resurgent Reference Number
- Your Account Number
In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.
We will use this information to verify whether or not we have any personal information for you. Upon the completion of that determination, we will send you either: (i) the information requested; (ii) the reason why we are not obligated to provide the information requested; (iii) notification that you have not provided enough information to verify whether or not we have any personal information for you and what information is necessary to confirm whether we have your personal information; or (iv) notice that we have no personal information for you.
Right to Non-Discrimination for the Exercise of a Consumer's Privacy Rights
California residents have the right to be free from discrimination based upon their choice to exercise their rights under the CCPA.

This CCPA Disclosure was last updated and became effective on the date posted at the top of this page.
